Appeal Court sets aside judgment that disqualified David Lyon as APC candidate

The Court of Appeal sitting in Port Harcourt has set aside the High Court judgment in Yenagoa that disqualified all APC Candidates from contesting the November 16 governorship election in Bayelsa State.

The Federal High Court in Yenagoa had on 14 November 2019 disqualified all APC candidates from contesting the governorship election because the primaries did not follow party guidelines.

The case was initiated by Former Minister, Heineken Lokpobiri, one of the APC Governorship aspirants who insisted he won the primaries.

However, the Court of Appeal while delivering judgment over the matter declared David Lyon as the authentic candidate of APC for the November 16 gubernatorial election in Bayelsa State.

The Appeal Court said the nomination and sponsorship of David Lyon as APC candidate is according to party guidelines.

The Appeal Court also said that the appeal filed by Heineken Olokpobiri was filed out of time and described it as an academic exercise.

Speaking to newsmen outside the court, the lawyer of APC, Sydney Igbanichuka said they were satisfied with the outcome of the judgment.

Sydney Igbanichuka said the Appeal Court was able to reconcile the appeals and struck out the High Court judgment that disqualified their governorship candidate.

Also speaking, Micheal Muna, the lawyer of David Lyon said the court judgment will enable his client to prepare for his inauguration as the Governor of Bayelsa State.

Micheal Muna also described the judgment as a welcomed development.
