An Africa Democratic Congress, ADC, aspirant for the Rivers State House of Assembly, Khana Constituency One, Legborsi Nwiabu, has dragged the party before the Federal High Court in Port Harcourt over his alleged unlawful exclusion from the party primaries.
Joined as respondents in the suit are the party’s candidate for the 2027 general election in the constituency, Bright Nulee, and the Independent National Electoral Commission (INEC).
At the hearing, counsel to the ADC, Emenike Ebete, informed the court of a committee set up to resolve disputes arising from the primaries and orally sought leave for the matter to be settled amicably out of court.
While counsel to the second and third respondents did not oppose the application, counsel to the plaintiff, Felix Beragbara, vehemently kicked against it, stating that his client was never informed of any such committee.
Justice Muhammed Turaki, after listening to arguments from all sides, granted the parties leave to explore out-of-court settlement and adjourned the matter to August 12, 2026, for report of settlement or definite hearing.
Speaking to journalists after the proceedings, Beragbara explained the circumstances that forced his client to seek judicial intervention, stressing Nwiabu’s readiness to return to court if the committee fails to deliver justice.
Counsel to the ADC, Emenike Ebete, counsel to the second respondent, B.F. Opara, and INEC’s counsel declined to comment on the matter.
