Breaking: Appeal Court strikes out Tonye Cole’s appeal against FHC ruling

An Appeal Court sitting in Port Harcourt has struck out the appeal filed by the All Progressive Congress APC, challenging the judgment delivered by JAMES OMOTOSHO of the Federal High Court which barred APC from fielding candidates in the 2019 elections in Rivers state.

Justice M. A Lamido in his judgement described the appeal with suit number CA/PH/38/2019 as an academic exercise that lacks merit.

Justice Lamido affirmed that the appeal court is bound by the decision of the supreme court which ruled that APC in Rivers state cannot field candidates for governorship, state house of assembly or national assembly elections.

Speaking to our reporter Tina Amanda, counsel to PDP Dike Udenna, said the law remains sacrosanct as political parties must conduct primaries before participating in an election.

Also speaking, Counsel to APC, Chimenin Jerome, said they will contest the judgement at the supreme court, stressing that the supreme court did not determine the merit of any case nor did it pronounce nomination and sponsorship of candidates in any of its judgement delivered.
