There was confusion on Monday over the ruling of the Court of Appeal sitting in Ibadan on the gubernatorial election of Seyi Makinde of the Peoples Democratic Party.
Theportcitynews had earlier reported the nullification of Mr Makinde’s election, citing Daily Nigerian.
The appellate Court had also disagreed with the ruling of the election petition tribunal which upheld the victory of Governor Makinde.
The court also dismissed the appeal filed by Adebayo Adelabu, the candidate of the All Progressives Congress.
Justice Abubakar Yahaya, who led the four-man panel of appeal court judges disagreed with the lower court on issues bordering on documents tendered by the APC.
He held that the documents tendered by the appellants ought to have guided the Tribunal through proper investigation.
The Judge stressed that the pieces of evidence were also not adequately evaluated, Channels Television reports.
He noted that the Tribunal had committed a miscarriage of justice by its failure to analyse the tendered documents and its failure to evaluate the pieces of evidence presented by the APC.
Eyitayo Jegede, counsel to the PDP told newsmen that Makinde remains the governor since there has been no counter directive by the appellate court on his victory.
Also, Mr Adeboye Shobanjo, the lead counsel for the APC agreed with the court for allowing the appeal to hold.
He, however, stressed that the Tribunal delivered a one-sided judgement.
