Breaking: Court orders Busola Dakolo, Biodun Fatoyinbo to appear before it

A Federal High Court sitting in the Federal Capital Territory, Abuja has summoned founder of Commonwealth of Zion Assembly, Biodun Fatoyinbo and celebrity photographer, Mrs Busola Dakolo to appear before it within 14 days.

In a suit, she filed at a High Court of the Federal Capital Territory in Abuja, Mrs Dakolo claimed that the alleged action of Fatoyinbo adversely affected her marital sex life.

She, therefore, demanded “a personal letter of apology” from the cleric to show honest remorse for his misdeeds.

In her suit, which was filed on her behalf by her lawyer, Pelumi Olajengbesi and Co of Law corridor, and exclusively obtained by The Punch in Abuja on Sunday, Mrs Dakolo asked the court to declare that Fatoyinbo’s denial of his alleged acts contained jointly and/or severally through a press statement he released on June 28 2019, had caused her continuous emotional distress and amounted to intentional infliction of emotional distress on her.

Olajengbesi said, “The claimant avers that she was immediately terrified and in shock while the defendant pinned her down on the couch following which he caressed her body, fondled her breasts, pulled her pant, quickly half-pulled his trousers and ordered her to allow him to have his way with her.

“The claimant avers that the defendant in the process used his hand to cover her mouth, thereby muffling her screams. The claimant avers that the defendant made efforts to penetrate her vagina, whilst she struggled to fight him off; however, the defendant overpowered her and penetrated her vagina and had sexual intercourse with her.

“The claimant avers that while she was in shock of the incident which had rendered her befuddled and mortified, the defendant rushed out of the living room area of her family home and briefly returned with a bottle of soda (Krest) which he forced down her throat thereby making her breathing difficult.”

The Senior Pastor of Commonwealth of Zion Assembly, Biodun Fatoyinbo, was reportedly currently interrogated at Police Force Criminal Investigation Department, Headquarters in Abuja over rape allegations made by Mrs Busola Dakolo two weeks ago.

Fatoyinbo was interviewed by a team of Four led by Asst Commissioner of Police Adaku Uche Anya.

Busola Dakolo, the wife of singer Timi Dakolo had alleged in an interview that the flamboyant pastor raped her in 1999 when she was 16.

Sources confirmed that Dakolo was interviewed by detectives to shed more light on the alleged rape which reportedly occurred when she was a teenager.

The police involvement came weeks after the cleric shunned an invitation extended to him by police officers probing the allegations.

He also shunned an invitation by the Pentecostal Fellowship of Nigeria, PFN, for an investigation into the matter.

The pastor had serially denied long list of rape accusations against him which began in 2013 when Miss Ese Walters accused the pastor of sexual misbehaviour.

The Force Public Relations Officer, DCP Frank Mba, confirmed the arrest.

Responding to a question, Mba said, “Yes, he is in our custody.”

When asked if the pastor was being detained, the Force spokesman said it was too early to say.

He also said the investigation of Fatoyinbo was proof that the police had not swept the matter under the carpet as was being insinuated in some quarters.

When asked why it took so long for the pastor to be invited, Mba said the police wanted to get statements from several witnesses and then build a solid case before inviting him.

The police spokesman said, “We have done a whole lot of background investigations and spoken to a whole lot of people before now. It was a deliberate investigative procedure to bring him last. Although we may invite others later depending on how investigations go.

“We were not in a hurry to bring him because we wanted to have enough background information that would be used in interrogating him. We have done an extensive investigation.”
