Sam Altman: ChatGPT Conversations Not Legally Protected

Sam Altman, the Chief Executive Officer of OpenAI, stated that interactions with its well-known AI tool, ChatGPT, are not currently shielded by any legal privilege and could potentially be used as evidence in legal cases.

He revealed this information during an appearance on the This Past Weekend podcast, which is hosted by comedian Theo Von.

Altman expressed his worries regarding the amount of personal and sensitive information users disclose to the chatbot, especially among young individuals who often rely on it for emotional support.

“People share deeply personal details about their lives with ChatGPT.

“Especially young people, they use it as a therapist or a life coach, discussing relationship issues and asking, ‘what should I do?’” he remarked.

He pointed out that, unlike discussions with medical or legal professionals, interactions with ChatGPT do not fall under current confidentiality protections.

“And at this moment, if you speak with a therapist, lawyer, or doctor about those concerns, it is protected by legal privilege.

“There’s doctor-patient confidentiality, legal confidentiality, and so on. “And we haven’t yet resolved that for conversations with ChatGPT,” he added.

Altman cautioned that this legal uncertainty could have significant consequences. “If you confide in ChatGPT about the most sensitive matters and later there’s a lawsuit or something, we may be required to provide that information.

“If someone shares their most personal difficulties with ChatGPT, and it comes up in legal action, we might have to turn it over. That’s a serious issue,” he stated.

The tech leader urged urgent measures to close the privacy gap in AI communications.

“I believe that’s very troubling. We should have similar privacy standards for your interactions with AI as we do with therapists or similar professionals, and this wasn’t even a consideration a year ago,” Altman concluded.
