Appeal Court dismisses suit against Umahi, deputy

An Appeal Court in Enugu State on Friday dismissed a suit seeking the removal of Ebonyi State Governor, Dave Umahi and his Deputy, Dr. Kelechi Igwe, from office.

The suit against Umahi was filed by the APC governorship candidate in the state’s 2019 election, Senator Soni Ogbuoji and running mate, Justin Mbam.

The suit sought his removal from office over his defection from the Peoples Democratic Party (PDP) to the All Progressives Congress (APC).

Recall that a High Court sitting in Abuja and presided over by Justice Inyang Ekwo had sacked Umahi, his deputy and 17 lawmakers in the state for dumping the PDP to the APC.

However, on February 28, 2022, a High Court in Abakaliki, the Ebonyi State capital, struck out the same suit on the grounds that it is inconsistent with the constitution of the country.

It had also awarded the sum of five hundred thousand naira as damage against Senator Ogbuoji.
