Appeal Court warns against further action on Rotimi Amaechi

Court of Appeal sitting in Port Harcourt has warned against any further action from the order of a Rivers State High Court in a criminal suit by Rivers State Government against former governor of the state, Rotimi Amaechi and five others.

The State High Court presided over by Justice Chiwendu Nwogu had on 17 May 2023 issued a warrant of arrest against former governor of Rivers State, Rotimi Amaechi, Governorship Candidate of APC, Patrick Tonye-Cole, former Commissioner for Energy, Augustine Wokocha and three others.

When the matter resumed at the court of appeal, a Senior Advocate of Nigeria, Akin Olujimi, Counsel to Rotimi Amaechi, informed the court about the ruling of Justice Chiwendu Nwogu of the state high court on the criminal suit, which he said is in disregard to stay of proceedings pending before the appeal court.

Olujimi also drew the court’s attention to an application to set aside the Rivers state High Court proceedings pending before the appeal court, which the state high court also disregarded.

Our Correspondent reports that the three-man panel led by Justice Joseph Ikyegh reserved ruling on the applications after the parties argued and adopted their final written addresses and warned that every action must cease pending the outcome of the appeal court’s ruling.

Counsel to Rotimi Olujimi SAN, in an interview with our Correspondent, said they, as counsels must also assist the court on the proper thing to be done.
