Judge adjourns PDP’s suit seeking to delist Rivers APC NASS candidates for hearing

A Federal High court sitting in Port Harcourt has adjourned till 30th of September for definite hearing on motion of joinder and all pending applications on the Peoples Democratic Party, PDP suit challenging the legality of the All Progressives Congress, APC National Assembly candidates to contest the 2023 general election in Rivers State.

Our Correspondent reports that the presiding judge, justice Stephen Daylop-Pam adjourned due to plea from Counsel representing APC Tunduru Ede, that some motions have not been served and replies are yet to be served to parties with the new motion on joinder.

The Judge ordered that the rules of court in a matter of urgency, adjournment should not be granted twice, noting that such applications were geared towards causing unnecessary adjournment and insisted on hearing the matter.

Counsel to 4th Defendant, however reminded the court of pending motions on recuser, while Counsel to the 3rd Defendant, Emenike Ebete, told the court that their motion is not ripe for hearing and it is necessary for the court to grant the adjournment.

After listening to the submission of the parties, Justice Daylop-Pam adjourned the case to 30th September, 2022 for definite hearing on all pending application.

In an interview with our correspondent , Counsel to 3rd Defendant, Emenike Ebete, said it is a procedure that the court need to adjourn due to several pending motions.

In a related development, Justice Stephen Daylop-Pam, also adjourned to 4th October, 2022, for definite hearing on another suit filed by PDP challenging the National Assembly candidates of SDP in Rivers State.

Justice Daylop-Pam adjournment followed an application for joinder by interested candidates of SDP.

The Presiding Judge adjourned the matter to 4th October for hearing on motion of joinder and other pending motion.

Speaking to journalists, Femi Falana Counsel to SDP National Assembly candidates explained that they needed to take a look at the application of joinder which was filed that morning.

According to our corresondent, the Deputy Governor of the state, Dr Ipalibo Harry Banigo and some PDP and APC party leaders alongside their supporters were all present in court to witness the matter.
