Court Restrains Police from Arresting Lucky Omokhapub, 2 Others in Family Dispute

A High Court sitting in Port Harcourt has issued an interim injunction restraining the Inspector General of Police, the Rivers State Commissioner of Police, and the Nigerian Police, alongside three others, from arresting Lucky Omokhapub and two others.

The ruling follows a petition filed by Grace Garuba-Omokhapub, the fifth wife of the late Mr. Omokhapub, through the International Federation of Female Lawyers (FIDA).

Grace Garuba-Omokhapub accused Lucky Omokhapub, the first son of the deceased, and two others of threatening her life, and locking her out of her home, among other allegations.

Justice Jumbo Stephen, a vacation judge, ruled on the ex parte application supported by an affidavit of urgency filed by the applicants’ counsel, A.I. Salami.

The court issued an interim order restraining the police from arresting, harassing, detaining, or incarcerating the applicants.

The judge also directed the police to refrain from taking further steps against the claimants until the motion on notice is determined. Justice Stephen based the ruling on the Fundamental Rights Enforcement Act, 2009, and the provisions of Order 4, Rule 3, and Order 4, Rule 4 of the court rules.

The case has been adjourned to January 6, 2025, for the hearing of the motion on notice.
