Court resumes sitting on suit by Rivers aspirant against PDP, others

An Abuja Federal High Court has resumed sitting on the suit filed by Legborsi Yamaabana, an aspirant of the Peoples Democratic Party (PDP) in Rivers State, challenging his disqualification from participating in the party’s primaries for Khana/Gokana Federal Constituency.

In an order on Thursday, the court directed that all processes in the suit be served on member representing Khana/Gokana Federal Constituency, Dumamene Dekor by substituted means.

This followed an ex-parte application moved by counsel for the claimant, F.G. Warmate. 

Although the 1st respondent (PDP and Legborsi) and the applicant were present in Court with their lawyers, the 2nd and 3rd respondents (Dum Dekor and INEC) were absent.

After listening to the motion raised by the claimant, the presiding Judge granted the ex-parte application and adjourned the matter to July 7, 2022, for hearing.

Yamaabana had, some weeks ago, filed a suit at the Federal High Court against the PDP, Independent National Election Commission (INEC), and Dumamene Dekor, challenging his disqualification from the party’s primaries for Khana/Gokana Federal Constituency.

The aggrieved aspirant had also in a petition with other aspirants sought clarification from the national screening committee on the matter.

Reacting to the court order, Yamaabana, who is also the leader of the Ogoni Youths Federation expressed deep confidence in the judicial system while noting that justice shall prevail.
