A federal High Court sitting in Port Harcourt has struck out the suit seeking to stop Edo State governor, Godwin Obaseki, from contesting the gubernatorial primary of the Peoples Democratic Party, PDP.
The court had earlier stood down the suit seeking for an interim injunction against the candidacy Obaseki filed by Omoregie Ogbeide-Ihama, a Governorship aspirant of the Peoples Democratic Party, PDP.
Ogbeide-Ihama, in his suit, asked the court to compel the Party not to allow Governor Godwin Obaseki to participate in the already scheduled primary of the party.
Justice Emmanuel Obile stood down the suit for three hours after the Plaintiff’s Counsel, Ferdinand Orbih told the court to stand down the matter for Parties to settle outside the court.
Justice Obile mentioned to the parties involved that he does not stand down matters in court, but granted the request based on the urgency of the suit.
Ferdinand Orbih filed an application praying the court to give a standing order to enable the parties to tidy up and resolve the matter amicably outside the judiciary process.
All the Defendants’ Counsels in the matter did not oppose the application to settle out of court.
But the court upon resuming on the matter in the afternoon struck out the suit after the plaintiff’s lead counsel, D. C. Denwigwe (SAN), withdrew the suit on the grounds that all parties had settled amicably.
Justice Obile commended the parties for settling out of court, adding that it was the proper thing to do.
