National and State Assembly Election Petition Tribunal sitting in Port Harcourt have dismissed the petition filed by the candidate of the All Progressives Grand Alliance for Akuku Toru-Asari Toru federal constituency, IBINABO AMACHREE, against the declaration of BOMA GOODHEAD of the Peoples Democratic Party as the winner of the election by the Independent National Electoral Commission.
The three-man panel led by Justice G.K Kaigama in a unanimous judgment ruled that the first and second petitioner failed to prove their petition beyond a reasonable doubt.
Justice Kaigama ruled that the petitioners failed to provide two sets of results sheets that differentiate fake from the original, to back up their claims that the result sheets used in declaring Boma Goodhead as the winner was fake.
The judge, however, ruled that the petitioners failed to mention the total number of votes scored by other political parties during the election and did not call witnesses from the ward, local government and Central Collation centres to prove their claim that they won the majority votes cast.
Justice Kaigama awarded the sum of two hundred thousand (200,000) naira as cost in favour of the Respondents.
Speaking to our reporter Tina Amanda, Member representing Akuku Toru-Asari Toru federal constituency, BOMA GOODHEAD, said the judgment was a prove of justice as the tribunal has confirmed that INEC was right to declare her as the duly elected winner for Akuku-Toru Asari-Toru Federal Constituency.
She assured her commitment to providing excellent representation to her people.
