Federal High Court Sets April 10 Hearing for Suit Challenging Rivers State Sole Administrator Appointment

A legal battle is brewing in Abuja, with the Federal High Court setting April 10th as the date to hear a case that could significantly impact the governance of Rivers State. The core of the issue is the appointment of Vice Admiral Ibok-Ete Ekwe Ibas as the state’s sole administrator, a move that is now being challenged as unconstitutional.

The lawsuit, filed by Abuja-based lawyer Johnmary Jideobi, is generating considerable attention. It’s not just about Rivers State; it raises fundamental questions about the balance of power between the federal government and state authorities. The case, numbered FHC/ABJ/CS/572/2025, lists President Bola Tinubu as the primary defendant, highlighting the direct challenge to presidential authority.

Jideobi’s argument centers on the claim that the appointment of a Sole Administrator is not provided for in the Nigerian Constitution. He’s asking the court to declare all actions taken by Ibas in his role as null and void. Furthermore, he seeks a permanent injunction to prevent the President from making similar appointments in any state in the future and also to prevent the president from interfering with the tenures of elected state governors.

The legal arguments presented highlight a deep concern about the potential for executive overreach. The plaintiff’s legal team has emphasized that the Constitution outlines specific procedures for the removal of a governor, and these procedures do not include the presidential appointment of a sole administrator.

This case has drawn in the attorneys general of all 36 states as defendants, underscoring the nationwide implications of the court’s decision. Legal experts are closely watching, as the outcome could set a precedent that reshapes the relationship between the federal and state governments.

The April 10th hearing, before Justice James Omotosho, is expected to be a pivotal moment. The court will have to consider complex constitutional questions, and its decision will have far-reaching consequences.
