Court restrains Martin Amaewhule, others from parading as members of Rivers house assembly

A High Court sitting in Port Harcourt has granted an order of interlocutory injunction restraining Martin Amaewhule and twenty four other lawmakers from parading and holding themselves as members of the Rivers State House of Assembly.

The court presided over by Justice C.N Wali also granted an order of interlocutory injunction restraining governor Siminalayi Fubara, State Attorney General and commissioner for justice and Chief Judge of Rivers State who are 26 to 228 Defendants in the suit from dealing with, interfacing, accepting any resolution bill and it whatever from the Martin Amaewhule and twenty four others.

Justice Wali in a ruling in a suit filed by Victor Oko-Jumbo as a Speaker, Sokari Goodboy and Orubienimigha Adolphus-Timothy as claimants restrained Martin Amaewhule and twenty four others from sitting in Auditorium of House of Assembly quarter located along Aba Road, Port Harcourt or at any other place to carry out any legislative function of Rivers State House of Assembly.

The court equally declared the seats of Martin Amaewhule and twenty four others vacant pending the hearing and determination of the substantive suit and thereafter adjourned the matter to 1st July 2024 for motion.

Meanwhile Court of Appeal sitting in Port Harcourt will on Monday, 2nd June deliver ruling on the applications brought before it by Martin Amaewhule and twenty four others against the decision of Rivers State High Court sitting in Port Harcourt in a suit filed by Victor Oko-Jumbo and others.

Justice C N Wali of Rivers State High Court had issued an experte orders against Martin Amaewhule and twenty four restraining them from parading themselves as members of House of Assembly and holding any seating.

Martin Amaewhule and twenty four had appeal the experte orders against them and asking the court to vacate and dismiss the suit.

At resumed hearing today, the respondents Victor Oko-Jumbo and others filed a counter and the court directed the plaintiff to respond on or before 12 noon Friday 31, 2024 and show proof of service on the respondents through any means either through WhatsApp.

Counsel to the plaintiff told the court to consolidate all the applications before it, following the interlocutory injunction issued by a Rivers High Court despite the pendency of the appeal before a higher court.

The three man panel of appeal also directed the respondents to respond on or before Monday, 3rd June, 2024, before the resumed hearing and ruling on the application.
