Gberegbe’s murder: Court okays PSC as 3rd defendant

Justice Adolphus Enebeli of a Rivers State High Court sitting in Port Harcourt has ruled that the Police Service Commission should be joined as the third Defendant in the suit filed against the Rivers State Commissioner of Police and the former Rivers State SARS Commander, Akin Fakorede over the murder of Dr Ferry Gberegbere.

Gberegbe, a lecturer at the Ken Saro-Wiwa Polytechnic, Bori was murdered at the Bori Collation centre by SARS officers allegedly led by Mr Gberegbe during the 2019 Governorship Election in Rivers State.

Justice Enebeli in his ruling joined the police Services Commission as a party based on the circumstance of the suit.

He stressed that the Commission is the employer of the Commissioner, Akin Fakorede and all serving Police officers.

Just Enebeli also ruled against joining the Nigerian Police as Defendant in the matter as requested by the Plaintiff’s counsel, with reasons that Nigerian Police as a body is an aggregate of all Nigerian forces.

The judge ordered that all parties in the matter be served the amended process accordingly, and adjourned the matter to 29th November, 12th and 19th December for hearing.

Recall that Lezina Amegwa, counsel to the Plantiff had filed a motion for a joinder before the court.

Amegwa had sought for the Nigerian Police and Police Service Commission to be joined in the case.

Lezina Amegwa, Counsel to the deceased wife, Funmi Gberegbere, told our reporter Tina Amanda, that they are in order with the ruling of the court, as the ruling automatically joined Police service Commission as a party in the suit

On his part, Essien Edet, Counsel to the Nigerian Police on the matter, said they are ready to continue with the oral evidence in the matter, as the oral evidence has been delayed due to the controversy surrounding the case.
