A high court sitting Port Harcourt has struck out the 3rd count charge against former lawmaker in the Rivers State House of Assembly, Chidi Lloyd, on the malicious destruction of state property the mace.
Recall that the matter was fixed for plea at the last adjourned date.
During the court proceeding, the prosecuting counsel DAMILARE GEORGE ADEYEMI filed a nolle prosequi application from the Attorney general of the state, which is drawn from section 211 of the 1999 constitution as amended and section 107 of Rivers State government administration of Criminal Justice Law.
The Defendant counsel didn’t oppose the application presented before the court.
Justice CHIWENDU WORGU, In his ruling, struck out the case based on the nolle prosequi from the Attorney general Zacheous Adango, through the prosecuting counsel.
Speaking to our reporter Tina Stephen, PRINCE ONYEKWERE AZUNDA, counsel to Chidi Lloyd, said his client should be allowed to enjoy his fundamental right, adding that the matter should not be called up again.
On his part, Prosecuting counsel DAMILARE GEORGE ADEYEMI, said the matter was not dismissed but struck out, stressing that the court didn’t hear evidence on the matter and that the matter lacks merit.
