The Allied Peoples Movement (APM) has filed a motion at the Federal High Court sitting in Port Harcourt praying the court to mandate INEC to delist the Peoples Democratic Party (PDP) and its governorship candidate, Sim Fubara from contesting the 2023 general election.
APM, in its suit, said the PDP and its guber candidate commenced campaigns outside the period prescribed by the electoral act.
It also asked the court to mandate INEC to delist PDP and its governorship candidate from the recently published list for contravening electoral guidelines.
The motion said that Fubara having commenced the campaign by the use of public print media and electronic media during the period outside the prescribed time by INEC is not entitled to contest the 2023 general election.
It also said Fubara, who is a serving Accountant General of the State, is a civil servant under the employment of the Rivers State Government and thus not eligible or qualified to engage in partisan politics.
The APM also prayed the court to order INEC to remove the names of Fubara and his running mate, Ngozi Ordu from the published lists of nominated or sponsored candidates eligible to contest the 2023 general election or from any list, ballot paper, or election materials or nay name submitted by the PDP.
The APM also asked the court to direct INEC to prosecute the PDP and its governorship candidates for being in violation of the provisions of section 94 subsection one of the Electoral Act.
